Terms of Use

1. Scope

These Terms of Use apply to the use of the mobile applications and services published under the names PPL Training & Exam Preparation, ppl-ecqb-app, and all related variants (hereinafter "the App").

Provider: Clesk Digital GmbH, Am Biehl 5, 57234 Wilnsdorf, Germany (hereinafter "we" or "Provider").

2. Description of Services

The App is a learning application for preparing for the PPL(A) theory examination. It offers:

• Access to the ICQB-PPL question database (provided by Aircademy GmbH)
• An FSRS-based learning algorithm for efficient spaced repetition
• Exam simulations with evaluation
• Learning statistics and progress tracking
• Bookmarks and note-taking features

3. Disclaimer Regarding Exam Success

The App does not replace official flight training or exam preparation conducted by an approved flight school. Specifically:

• No guarantee is given for passing the PPL(A) theory examination.
• The question database serves practice purposes only. Actual exam questions may differ.
• No warranty is given for the accuracy, completeness, or currency of questions and answers.
• The App does not replace advice from an approved flight school (ATO/DTO).

4. Premium Subscriptions

4.1 Scope

The App offers extended features through paid subscriptions. The exact scope of features, available durations, and prices are displayed in the App and the respective App Store.

4.2 Processing and Cancellation

• Payment processing is handled exclusively through the respective App Store (Google Play Store or Apple App Store).
• Subscriptions renew automatically for the selected duration unless cancelled at least 24 hours before the end of the current period.
• Cancellation is managed through the subscription settings of the respective App Store.
• Upon cancellation, access remains available until the end of the paid period.

4.3 Right of Withdrawal

For subscriptions purchased through the Apple App Store or Google Play Store, the withdrawal and refund policies of the respective App Store apply. Refund requests should be directed to the respective App Store.

5. Intellectual Property

• The ICQB-PPL question database is provided by Aircademy GmbH and is protected by copyright.
• Design, code, and other content of the App are the property of Clesk Digital GmbH and are protected by copyright.
• Any reproduction, distribution, or other use of the content requires prior written consent of the respective rights holder.

6. Availability

• There is no entitlement to uninterrupted availability of the App.
• We reserve the right to modify, expand, or discontinue the App at any time.
• Maintenance and updates may lead to temporary restrictions.

7. Liability

• The Provider's liability is limited to intent and gross negligence.
• In cases of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations), limited to foreseeable, contract-typical damages.
• The above limitations of liability do not apply to damages to life, body, or health.

8. Changes to Terms of Use

We reserve the right to amend these Terms of Use at any time. Users will be informed of material changes in an appropriate manner. Continued use of the App after changes to the Terms of Use constitutes acceptance.

9. Applicable Law and Jurisdiction

• The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
• The place of jurisdiction for all disputes is Siegen, provided the user is a merchant or has no general place of jurisdiction in Germany.

10. Severability Clause

Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall not be affected.
